TERMS OF SERVICE

Welcome to GoTap Inc (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our custom menu application (the “Service”). By accessing or using the Service, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. ELIGIBILITY

By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement.

2. ACCOUNT REGISTRATION

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. SUBSCRIPTIONS & PAYMENTS

  • The Service is offered on a subscription basis, with payment processing managed by Stripe.com.
  • Administrators may upgrade, downgrade, or cancel their subscription at any time through Stripe.
  • All subscriptions are final and non-refundable. There are no refunds or pro-rated adjustments for unused portions of your subscription.

 

4. DATA COLLECTION & PRIVACY

We collect only the minimum amount of information necessary for the operation of the Service. Payment information is not stored by us but managed by Stripe.com in accordance with their policies.

5. ACCEPTABLE USE

You agree not to:

  • Use the Service for any unlawful or fraudulent purpose.
  • Attempt to reverse-engineer, modify, or disrupt the Service.
  • Share your login credentials with unauthorized users.
  • Use the Service in a way that could harm or overburden our infrastructure.

Violation of this section may result in suspension or termination of your access to the Service.

6. TERMINATION

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we determine that your use of the Service poses a security or operational risk.

7. WARRANTY DISCLAIMER

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOTAP INC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

GOTAP INC MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS, OR THAT ANY CONTENT OR DATA PROVIDED THROUGH THE SERVICE WILL BE ACCURATE OR RELIABLE.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GOTAP INC, ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITIES, LOSS OF DATA, OR LOSS OF REPUTATION, ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

UNDER NO CIRCUMSTANCES SHALL GOTAP INC’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT EXCEED THE AMOUNT YOU HAVE ACTUALLY PAID TO GOTAP INC FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN SUCH JURISDICTIONS, SOME OF THE ABOVE DISCLAIMERS AND LIMITATIONS MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY LAW.

California Residents. IF YOU ARE A CALIFORNIA RESIDENT, YOU HEREBY WAIVE CALIFORNIA CIVIL CODE 1542 IN CONNECTION WITH ANY RELEASE PROVIDED BY YOU IN THESE TERMS OF USE, INCLUDING THE FOREGOING, WHICH SECTION STATES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”

9. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Tarrant County, Texas.

10. LANGUAGE

These Terms are written in English. In the event of any translation, the English version shall prevail.

11. CHANGES TO THESE TERMS

We reserve the right to update or modify these Terms at any time. If changes are significant, we will notify you via email or through the Service. Your continued use of the Service after any changes means you accept the updated Terms.
